Defense lost their motion on rules 48.14(7) judge grant my case the go ahead!

Update,
 What a week I had last week! First and foremost the doctor that was eluding me and unable to serve according to my former lawyer has been serve last week after 3 years of chasing him! Turn out he was exactly where I relay the information to my former lawyer 2 years ago!

When my detective finally got a hold of Dr Greenspoon seem like he is more arrogant than he was when I was seeing him! He had the nerve to tell him that "If he want him to "Come find me". Well don't know what he told him but Dr Greenspoon called back the next day and said he would be at the clinic in BC on Tuesday and Thursday! He was serves on Thursday the 18 June at 10:30 am  with my amendment.claim!

Now I have everyone serves, got my schedule with the court on track. A friend of mine help me to amend my claim and now the defense is looking to delay since she (lawyer)says she needs more time! Wow according to the defense I was waisting the court time with delay and now the shoe is on the other foot! It's all good since it give me more time to find a proper lawyer to be able to proceed and succeed with my  case! All in all a great and productive week!

Wow what a day I had yesterday! Went to court to argue why my case should move forward and the defendants case should be dismiss! The lawyer for the defendants was trying a new law call rules 48.14(7) that pass this year to dismiss my case. I explained that my case should move forward since I did follow the rules that the judges has set out to show that indeed I was active all along with my case and that I did my due diligence by researching and finding a test that I was repeatedly told that did not exist!

Also I point out in the evidence that I have in the binder I created for the court and the defense that these doctors overdose me since in 2008 the legal amount for Botox injection set out by Health Canada was 1 Vial Botox 100/u/Vials and even with the revised dosage which I updated from Health Canada recently it shows that the new limits is 2 Vials 100u/Vials. I was giving 4 Vials to start with and then increase to 6 Vials which is over the limit from the beginning!

The defense only recourse was to use in their motion rules 48.14(7) which the judge reject and agree with me that I did indeed show that I was active all along and that my case should move forward step by step with direction she gave me and advise me that now I need to make a bigger effort to find a lawyer since we are moving into the next phase before the pre-trial!

I also argue that I have tried but many lawyers are demanding that I get an expert report and won't touch my case until I do have one. The judge ask the defense about a case where it was dismiss due to the inability to find a expert since the defense brought up that there is indeed lawyers that would take my case without a expert and the defense had to agree with the judge.

All in all it was a long an exhausting day but well worth it since I do believe I just set a new precedence in jurisprudence with the judge ruling in my favor. Now I need to start fresh with a new claim and need to have it by May 26 2015. Judge also told me not to worry about an expert right now since my case is moving forward, but will keep looking like I did when I was searching for a test I was told repeatedly could not be found!

Now my most pressing issue is to find a lawyer that can help me move my case forward and make a fresh claim that excluded the College of Physicians since it is a third party and not admissible in court and was added to my original claim. which baffle me!

Added the result of my test proving my system and body has been poison by Botox and now spread throughout! Also show I still have a illegal amount in my system that cause my severe reactions. Condition which is called Botulism toxin!

Defense wanted to dismiss my case in it's entirety, Judge gave me 7weeks!

What a day I had yesterday! Finally went to court and got a postponement! The defense tried to dismiss my case in it's entirely but after arguing that indeed I was not wasting the court time I ask for 3 months postponement the defense ask for 5 weeks. the judge rule in my favor and gave me 7 weeks to get my case together and the motion to dismiss was deny.

I explain that one of the reason it takes me awhile is because of confusion, communication breakdown of what I or my lawyer role was. Also I deal with my lost of sense of sell and taste, nauseated 24/7  and dealing with chemically burn hands so it takes me awhile to respond and move fast since I have limited use of my hands due to their negligence!


The judge advise me that she was listening to the motion on the defense side and that I have no need to tell her all my symptoms! Will have time to debate this matter at another time!

1-Defense who is the plaintiff in this case  argue I was waisting the court time and that I was disrespecting the law by sitting idly while my case was not going anywhere! I did not make any effort to find a lawyer since December 2014

I told the court that indeed I have been looking for a lawyer through phone call and Internet. I was told by all of them that they will take my case only if I have a expert report.

I was waisting the court time because the defense clients are suffering from anxiety and fear that I will sued them without cause! Also they want compensation for the time and money spend on their case since my claim is bogus! Which I was able to show that indeed it's not the case!

2-Dr Greenspoon was not served despite finding his locations many time and paying extra fee to make sure he gets serve. Was advise by my former lawyer he could not be found! Was also told that I was unable to move forward with my case without all persons name on the claim was serve! How can I be held responsible when indeed I did find him but for unexplained reason my former lawyer claim he was unable to locate to serve him.

3. My claim about my symptom was bogus since according to the 3 doctors Botox was suppose to leave the system after 3 months. Here we are seven years later and still have over the limit of what Health Canada recommend! Proof from the Forensic labs show that I still have over the legal limit  in my system! Which show that there where negligent on their part of the defendant since they fail to take my symptoms seriously and investigate my condition! Doctors in this case did not follow proper protocol and due diligent by contacting or advising the proper authority like Health Canada about my severe reactions to Botox. They lied and cover it up instead and said it's impossible to have these symptom.Also was told they where no test available to detect Botox in my system, again here I prove that there is !

I Explain to the judge that thanks to "Forensic File I was able to learn on how to access the forensic labs since I made numerous call and sent numerous email and never heard back since I was asking the wrong question. Also forensic labs deal mostly with authority figure which I hired to access the lab for testing and that is how I got my result!

All in all I was able to successfully argue that indeed I have ground to move forward and that when I became aware of the problem  and the full extend of the repercussion I immediately took action to remedy the problem!

The defense now plaintiff is banking on the notion that the expert witness will cost too much or I will be unable to find one and this in turn will make me give up! I haven't up to now and I am presently looking for an expert that can explain why after all this time there is still an illegal amount of Botox in my system!

In a email to the defense lawyer when I sent her the result of my test I ask her that I would like her clients to explain to me the presence of an illegal amount of Botox still in my system if it was not negligence after all this time! This is after being repeatedly call  delusional, crazy which is not the case according to this test! Did not get an answer, not surprising!

During this time I need to get back my files from my former lawyer so that I can comply with the court and present my evidence and also make copies for both the court and the defense now palintiff by May 1 2015! Back in court on May 14 2015 and debate the motion again!

The judge told me that I can return to court with or without a lawyer which at that time on the 14 May 2015 we will be examining and debating the motion again and see how much progress I am making in moving this case along!


 I had no lawyer representing me. I was told that usually the defense gets the motion dismiss I debunk every argument that she had (lawyer for the defense)

Did not realize I had a victory yesterday until much later since I was in so much pain! But it is short live unless I stay vigilant and continue to work diligently on my case! My test result from forensic which show trace  of marijuana which I use to control my nauseating symptom and pain since I am unable to use any kind of medication without suffering severe effects and reactions and a illegal amount of Botox in my system!

Proof of my medical files being tampered with!

Here is more proof that my files where tampered with! Two different sheets, same date different diagnosis, same doctor, same time! They tried to change my DNA to fit their narrative! Having trouble downloading the images so I added my Google drive for more clarity!

You think that the doctors involve at the pain clinic would of been smarter when they finally give me my file after waiting for them for over a year! I guess they had so many correction to make that they got sloppy and left some trace of their sheer "stupidity"!

So many mistake were made that it baffle me that the College never pick up on this even after I pointed it out to them! Wrong dates that did not match my appointment calendar and my favorite one was stuck on another page. This one stood out like a sore thumb and the one that set me to give my files a thoroughly look! Signature from same doctor totally different on some sheets! Wrong doctor name that treated me that don't even work at the clinic at the time while the original one was scratches off! So here is the most obvious one that I am posting! Two separate sheets, different outcome, different time with same date!

No way did I get two treatment on the same day and minute apart! Here is the proof!

That is why I started a petition to stop this kind of abuse from doctors who think they can manipulate the outcome as they see fit! By doing this the patient has no where to go since the College always side with the doctor and when action is taking the patient is not even notified! We need a better process as to stop it or at least get a fair hearing which is not the case at the present moment! My second reply to the COP&S!

When I sent my complaint I was aware that they (doctors) would deny some of my statement but wow the extent of their lies and cover up really took me aback! They made me sound like I was out of control, a drug addict, a liar, crazy, delusional,  name it they through it at me! And also in the process spread innuendo to their colleague and made it difficult if not impossible to get help! So in my defense I though I would correct some of their statements.

I would of added their reply but it has over 30+ pages! So it is easier to put in my reply since they are shorter and to the point!

Here is the reply I sent them on July 9 2010,

I realize afterward that there was more I needed to say and felt compel to answer since with all these reactions there was bound for me to miss certain important detail, here is my response to their accusations! This letter was sent on August 17 2010

All in all The College came back in favor of these 3 doctors which baffled the heck out of me since I sent them proof of my files being tampered with and pictures of me during the reactions! I finally realize that they are one side on not on the patient well being! So I started a petition years ago and have lost track and almost forgot about it but I want to change this pattern of abuse and the only way to do that is change how patient are regarded when they have been wrong! We need a better way to deal with these complaints which some are genuine but being disregard because of the doctor stature! We have excellent doctors that do works for the good of the patients but they are other that regard the patient has a cash cow and that need to stop! "My original complaint to the COP&S!"

Going back that long ago bring back lots of animosity and anger that I though I had work through! The way I was treated not only by the doctors but let down by the College of Physicians&Surgeons! I will post some of the correspondence that I had with  COP&S! Though I share it with you!

To whom it may concern,

My name is Lise Latulippe and this is my second attempt to have my complaints taking seriously. My first complaint against these three doctors has been totally ignored. At that time I complain about the treatment that I was receiving by my family practitioner Dr N Shams and also against Dr A. Greenspoon and Dr G Chudnow of the Greenspoon Headache and Neck Pain clinic. Also I have made 2 attempts to get copies of my files from the Greenspoon pain management and both at the time where completely ignore. I have attach a copy of my formal complaint which detail how I have been blocked from getting access to my files and finding out why my body is still reacting to BOTOX.  Needless to say I got a call back Intake Triage Assistant and when I told her what BOTOX was doing to me she call me a liar and that BOTOX does not cause those side effects and reactions. Well let me explain to you what this really does to you and I can assure you that everything that I’m am telling you is the truth  I know first hand what this poison does to your nerves system and I know for sure that BOTOX is doing this to me. I have been telling my doctor that my lungs and heart is being greatly affected by my body constantly reacting to this poison. The scent and the blow it send to my body sometime is so powerful that it literally knocks me out and I can tell you exactly when that happen. And that should be in every doctors noted that I have encounter cause I told them that that was my biggest fear that my system won’t be able to handle much more. I was laugh and ridicule by my own Dr Shams when I mention this and told me that I was crazy and that I was not going to die and that I was lying and making these symptom and reactions up. Despites me taking the time to go and see him while my face look horrendous and despite my begging and pleading for his help. My biggest fear was confirmed a few weeks ago by my heart specialist. I redid an ECHO and a ECG test and was showing some improvement in the LV showed normal left ventricular systolic function since it had a mild dysfunction prior to the test in 2008. We redone the test again in December of 2009 and as I already suspected my heart as been taking the brunt of these side effects and reaction and nothing can be done for me at this point. I was told that my LV is deteriorating and degenerating there is no cure, no operation to save me. I was basically left to die on my own and try to figure out why this is happening to me and how to get from one reaction to the next   and they are very severe I can assure you. The worst reaction is the one that will deliver the final blow. Let me describe to you what will transpire before my heart gets attack. I feel a twinge and a pinch in the chest area and sends shocks to my heart. I feel like my lungs are drowning and make me gag which turn into a huge heartburn and send more shocks to the heart. Then I feel a tight squeeze and I am trying to catch my breath and instantly it feels like someone lit me on fire and my body literally cooks from the inside and it manifest itself on the outside of the skin. It turns into a huge body rashes and the swelling is atrocious and very painful. I have this obnoxious sweet and biter taste that is so nauseating that it burns the inside of my mouth and give me all the symptoms I have describe in my original complaint. But the most serious problem with these reactions is the smell and taste is so powerful it’s literally knocks me out. I have ask my cardiologist “how much more body blow can my system takes from these reaction before the final blow is delivered” Ironic she did not have an answer to that question. After being confirm that all along I have been trying to tell them that BOTOX does not leave the symptom and I am definite proof of it.

Since the first complaint beside being call a liar on the phone, I was told to go back and settle the dispute with my doctor and as for to get my files she gave me a number for my doctor to call to access my files if the clinic still refuse to release my file it can be reinforce through the Public Advisory Department. Well needless to say I had made 2 more request to get access to my files from the pain clinic and again got stonewall and got nothing referring to my BOTOX treatment that I received from the Greenspoon pain management. The last referral was sent on January 11 2010 still nothing. As for Dr Shams I have ask him why he did not call the PAD to request my files he tried to diffuse the situation and got me to ask Dr Koponen and see if she could help me and she flatly refuse since it is my family physician duty to get them for me and not hers. I also made 4 requests to get the full content of my files from him but again he was selected and none included why he has come to the conclusion that I am lying. I have told him time and again about my fears and what this BOTOX does to the nerves system. It’s like I’m on simmer and once and awhile the temperature is raise to high. That is not something I am making up it is really real. I have nothing to loose I was hung out to dry by these three doctors and there conduct leave a much more bitter taste than the one in my mouth now. This is an important health issue too important for me to die without letting you know the danger and the severity that it causes to the nerves systems. It might be something that was never heard of but nevertheless it is real and it did happen I am proof of that. Please look into the conduct of these three doctors. It was shameful the way that they treated me and Dr Shams has a very bad bedside manner. He has a habit of calling his patients liar, I am sure you will find lots of complaints if you talk to some of his patients that is not his nationality. He has a habit to belittle you and reprimand you like a child if your ideas don’t conform to his. I heard patient complain to him and he would sniff and scuff at what they say he shows the same contempt for me at times.  I put up with him so long because it was so hard to find a family physician, but at this point I don’t want anything more to do with him. I rather die without a doctor with my pride and dignity intact than to go back and suffer more humiliation, he is just shortening my life more by aggravating me so much. These three doctors not only fail me miserably but they failed to warn the public about the severity and how long term side effects and reactions are indeed real and fatal. BOTOX doesn’t leave the system like they claim it does it make you go through a long slow painful death. And that is reality. This is happening to me now and my biggest fear is there might be someone else out there that is dying like me and going through the same humiliation and being denied the truth about why this is happening to them. I understand more how this affects the system; I learn the hard way by living this way for over 18 months with no instruction on how to fight this. I wasn’t even giving a fighting chance to try and get help even though I shouted as loud as I could, but no one was listening. I guess Dr Shams display his real contempt to me when I was telling how happy that I finally talk to Dr Filkeinstein and how excited I was that I seen an allergist to try to finally get some answers and that it’s very probable that BOTOX cause this to me. . Well he made sure he put me down real good and that was his last time humiliating and degrading me. This is his exact words “What are you chance that they will say BOTOX is connected to your symptom, one in a million or one in a billion? I got so aggravated and infuriate and look him straight in the eye and told him I am the “One” I can’t believe he would say that knowing full well how hard this has been on me and what he has witness.. To be telling the truth and be call a liar is insulting. That seems to be his favorite pet peeves At that point I had enough and decide not to go back and put up with his abuse. I have taken many steps to reconcile my difference with Dr Shams even compromising on my part did not seems to bring any resolution just more pain. I try to bring awareness to this serious condition and to make sure that this doesn’t happen to anyone else. I was let down not only by these three doctors but also I fell I was abandon by the Government of Canada. This is getting too serious to ignore and took it upon myself to report my symptoms directly to the BOTOX Company which in turn advise me to get in contact with every doctors that I consult and talk in the past 18 months about this subject to call them immediately and report what I have convey to them They gave me a case # 1002754US and a phone number 1-800-433-8871 that the doctor needs to call. I abide by that and sent copies to all doctors that I have convey my side effects and reactions to and also gave them my consent to call BOTOX Company.

I have attached with this copy of almost everyone I had contact with to try to get help during this very traumatic and difficult times and copies of the request that where made to get copies of my files and  also a disc containing the photos of the reactions during BOTOX reactions.

Looking forward in hearing from you and would appreciated it if this time I would get a respond back through mail or email. Hopefully this matter can be giving a serious look and be giving priority. I have accepted my faith a long time ago and I know that nothing can be done for me. The only thing I am asking now is please don’t let me die in vain let me regain my self respect and dignity. This is a dangerous precedent when making money is more important than a human life.

In closing I want to thank you for taking the time to read my letter and am confident that this matter will receive the attention that is required.
